Black Horse Market is an online marketplace that allows sellers, trainers, breeders, barns, farms, and auction companies to list horses for sale, at stud, or at auction, and allows buyers to search, browse, and communicate with sellers about those listings.

Black Horse Market does not own, breed, board, train, transport, insure, or sell any horse listed on the Services, and does not act as an agent, broker, or representative for any buyer or seller in a transaction.

Any transaction, negotiation, agreement, deposit, payment, or transfer of a horse arranged between a buyer and a seller is solely between those parties. Black Horse Market is not a party to that transaction, and does not process, hold, guarantee, or insure funds exchanged between buyers and sellers unless a specific Black Horse Market service expressly states otherwise on BlackHorse.Market.

Black Horse Market does not independently inspect, evaluate, verify, or guarantee the accuracy of any horse, listing, pedigree, registration, competition record, health status, temperament, or other information supplied by a seller, except where a specific verification is expressly described on the Services.

Listings are created and maintained by sellers, who are solely responsible for their content and accuracy.

Buyers are solely responsible for independently investigating and verifying a horse and seller before entering into a transaction, including through an independent pre-purchase examination, review of registration and competition records, and direct communication with the seller and relevant third parties. Sellers are responsible for having the legal right to list and sell (or offer at stud or at auction) any horse they list, for complying with applicable law, and for honoring the terms of any transaction they enter into with a buyer.

Sellers must not intentionally misrepresent a horse's age, height, breed, registration, competition record, training level, temperament, health history, soundness, behavioral history, ownership, location, photographs, or videos. Listings that are inaccurate, misleading, or fraudulent may be removed and may result in suspension or termination of the seller's account.

A horse's presence on the Services does not guarantee it remains available for sale — a horse may sell, be withdrawn, or otherwise become unavailable at any time, including before a listing is updated or removed. Sellers are responsible for keeping listing status reasonably current.

You must provide accurate registration information and keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.

Sellers may create a public seller profile, including a business or barn name, location, biography, and listings. Sellers control certain privacy settings for their contact information, described in our Privacy Policy.

A Verified Seller badge, where displayed, means only what Black Horse Market specifically states was verified for that seller. It does not mean Black Horse Market guarantees the seller, guarantees any horse the seller lists, or guarantees any transaction. Buyers remain responsible for their own due diligence regardless of a seller's verification status.

The Champagne Collection is a curated presentation of certain listings that meet criteria Black Horse Market applies at its discretion. Inclusion in the Champagne Collection is an application-based curation decision, not a guarantee, endorsement, warranty, or certification of a horse's quality, health, or value, and does not alter the seller's sole responsibility for the accuracy of the listing.

Listings identified as "At Auction" are subject to the terms of the applicable auction event or auction company, which may be a third party. Black Horse Market is not the auctioneer and is not responsible for conducting, settling, or guaranteeing the outcome of any auction unless expressly stated otherwise.

Black Horse Market provides an internal messaging system so buyers and sellers can communicate about a listing. Messages may be stored and reviewed as reasonably necessary to provide the Services, enforce these Terms, investigate misuse, and comply with law. Do not use messaging to send unlawful, abusive, or deceptive content.

Users may report a listing, user, or conversation they believe raises a safety concern. Submitting a report does not automatically remove a listing, restrict an account, or notify the reported party. Black Horse Market reviews reports internally and may take action it determines appropriate, in its discretion.

Black Horse Market may review, edit, remove, or decline to publish any listing, message, or other content, and may warn, suspend, or terminate an account, for violation of these Terms, suspected fraud or abuse, or to protect the integrity of the Services — with or without prior notice, in our discretion.

Black Horse Market may offer artificial intelligence features, such as AI-assisted listing description generation. AI-generated content may contain errors and is not an independent representation, warranty, veterinary opinion, or guarantee about a horse. Sellers remain responsible for reviewing and confirming the accuracy of any AI-assisted content before publishing it.

Sellers are responsible for the photographs and videos they upload or link, and must have the right to use them. Listing photographs may be displayed on the Services and used as reasonably necessary to operate, display, and promote the listing and the marketplace.

By submitting text, photographs, videos, or other content to the Services ("User Content"), you grant Black Horse Market a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that User Content as reasonably necessary to operate, display, and promote the Services. You retain ownership of your User Content, and represent that you have the rights necessary to grant this license.

Horse videos may be hosted by, or embedded from, third-party video services such as YouTube. Use of embedded video is subject to that provider's own terms and privacy practices, and Black Horse Market is not responsible for third-party video service availability, content, or data practices.

Black Horse Market may charge fees for listings, upgrades, promotions, or other paid features, as described at the time of purchase. Fees are stated in U.S. dollars unless otherwise noted, and you agree to pay all fees associated with the features you select.

Except where required by law or expressly stated at the time of purchase, listing fees and other paid marketplace features are non-refundable once the associated service has been provided (for example, once a listing has been published). Where a refund is offered for a specific promotion or service, its own terms will control.

Black Horse Points are promotional loyalty points, not currency, and have no cash value. Black Horse Points are governed by the Black Horse Points & Rewards Program Terms, which supplement these Terms.

The Services may include affiliate links, sponsored content, or referral offers for third-party products and services related to the equine industry. Black Horse Market may receive compensation in connection with these offers. Third-party providers are responsible for their own products, services, and practices.

You agree not to:

• List a horse you do not have the right to sell, lease, or advertise
• Post false, misleading, or fraudulent listings, reviews, or communications
• Harass, threaten, or impersonate another user or Black Horse Market
• Attempt to circumvent messaging, safety, or verification features
• Use the Services for an unlawful purpose
• Interfere with the security or normal operation of the Services

You may not use automated means (including bots, scrapers, or crawlers) to access, copy, or collect content or data from the Services, except for standard search engine indexing that respects our robots.txt, without Black Horse Market's prior written permission.

The Black Horse Market name, logo, and the Services' design, software, and other Black Horse-Market-owned content are protected by intellectual property laws and may not be copied, modified, or used without permission, except as necessary to use the Services as intended.

If you believe content on the Services infringes your copyright, contact us at hello@blackhorse.market with a description of the copyrighted work, the material you believe infringes it, and your contact information, and we will review the report.

The Services may link to third-party websites and services. Black Horse Market is not responsible for the content, security, or privacy practices of third-party sites, and linking to them does not imply endorsement.

Nothing on the Services constitutes veterinary, legal, financial, or other professional advice. Buyers and sellers should consult qualified professionals — such as a veterinarian or attorney familiar with equine transactions — before making decisions based on information found on the Services.

Buying and selling horses, like any marketplace transaction, carries inherent risk, including the risk of inaccurate listings, fraud, and disputes between users. See our Buyer & Seller Safety guide for information on recognizing and reducing these risks.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. BLACK HORSE MARKET DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LISTING OR USER INFORMATION IS ACCURATE OR COMPLETE.

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACK HORSE MARKET WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ANY TRANSACTION WITH ANOTHER USER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BLACK HORSE MARKET'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID BLACK HORSE MARKET IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Disputes between buyers and sellers arising from a transaction are between those parties. Black Horse Market is not obligated to mediate or resolve user disputes, though we may consider them as part of marketplace enforcement described above.

You agree to indemnify and hold Black Horse Market harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your listings or other content, your transactions with other users, or your violation of these Terms.

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Services and close your account at any time. Sections of these Terms that by their nature should survive termination will survive.

We may add, change, or discontinue any part of the Services at any time, including features, listing categories, fees, and the Rewards Program, without liability to you.

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continuing to use the Services after a change takes effect constitutes acceptance of the updated Terms.

Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Services, you consent to receive communications from us electronically, including by email and through the Services. You agree that electronic communications satisfy any legal requirement that such communications be in writing.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or enter into a transaction on the Services. The Services are not directed to children under 13.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles, regardless of your location.

If a dispute arises between you and Black Horse Market, we encourage you to first contact us at hello@blackhorse.market so we can attempt to resolve it informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction and venue of the state or federal courts located in Arizona, and you consent to personal jurisdiction there.

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Black Horse Market's failure to enforce any provision of these Terms is not a waiver of its right to do so later.

These Terms, together with our Privacy Policy and any other policies referenced here (including the Black Horse Points & Rewards Program Terms), constitute the entire agreement between you and Black Horse Market regarding the Services, and supersede any prior agreements on the subject.
